EE: The Death Penalty Sentence Is Not Justified.
The 1960s brought challenges to the fundamental rectitude of the remnant penalty before the Fifth, eighth, and Fourteenth Amendments were interpreted as permitting the death penalty sentence. However, in the early 1960s, under the Eighth Amendment, the death penalty was considered unconstitutional, cruel and unusual punishment. The Supreme coquette in 1958, decided in Trop versus Dulles (356 U.S. 86) case, that the Eighth Amendment contained an evolving standardised of decency that marked the progress of a maturing society (Becker, 1968).

The law characterized the death penalty as arbitrary and capricious so the majority ruled that the death penalty constituted cruel and unusual punishment in violation of the Eighth Amendment to the U.S. Constitution and the due process in violation of the Fourteenth Amendment (University of Alaska Anchorage, 2012).
